Private Ballots No More

Privacy while voting is the cornerstone of free and fair elections. As Americans, we cannot imagine someone looking over our shoulder while we cast a ballot on Election Day - especially if that someone had a vested interest in the election. That is why it is hard to believe organized labor and some of its allies in Congress are pushing legislation that would take the right to cast a secret ballot away from employees while they decide to unionize. The Employee Free Choice Act will do just that, and this November voters must realize the impact of such legislation.


The Employee Free Choice Act rewrites current laws regarding the unionizing of workforces. Under current law, employees must first sign a card indicating a desire to consider union representation and then have a National Labor Relations Board (NLRB) supervised secret ballot election.

If enacted, this legislation would require the company and the NLRB to accept the card check without a secret ballot vote if more than 50 % of the employees submit authorization cards. 

The American Trucking Associations fully supports the right of workers to organize.  ATA also believes preserving an employee's right to cast a secret ballot - as voters do in the election of public officials - is critical to the integrity of the process. Any legislative proposal that denies a secret ballot election to workers is simply undemocratic.
